What tools are you running ?
I am having the same problem on Fedora.
4 identical boxes. All running Fedora Core 1 but the problem appears to be on only 2 of them.
I verified the problem with vserver-utiles .29 and the folowing smp kernels:
vmlinuz-2.4.23-vs1.22 
vmlinuz-2.4.24-vs1.22
vmlinuz-2.4.22ctxsmp-17c
Kernel vmlinuz-2.4.23-vs1.22 was compiled in one machines and the moved to the other boxes. The machine I compiled on has the socket.c problem. 2 of the other 3 boxes nerver reported the problem and last one  had it untill I untared the moved kernel and modules again.
vmlinuz-2.4.22ctxsmp-17c ran perfectly on the same machine on rh7.2 with no problem.
I am beginning to think it is some obscuer tools issue.
