sorry it seems i forgot to start the vserver.
here it is.
m@ubuntu:~$ sudo cat /proc/virtual/49152/sched
Password:
Token: 201
FillRate: 7
Interval: 24
TokensMin: 200
TokensMax: 1000
PrioBias: 0
VaVaVoom: 0
cpu 0: 32593 1677 63991

also i restarted the computer and now the spu limits atleast works.
now a hint on how to limit ram usage (the vserver be allowed to use as
much swap as it wants just a limitewd amount of ram) left. any idea?
any hint?
